Terms of Service

These Terms of Service ("Terms") govern your use of the Banany mobile application (the "App") operated by Banany ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 18 years old to create an account and use the App. By using the App, you represent and warrant that you meet this age requirement.
2. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to keep it up to date. You must notify us immediately of any unauthorized use of your account.
3. Use of the App
Banany provides tools for household childcare coordination, including family management, time tracking, and shift pay. You agree to use the App only for its intended purpose and in compliance with all applicable laws.
4. Prohibited Conduct
You agree not to:
- Use the App for any unlawful purpose
- Impersonate another person or misrepresent your affiliation with any person or entity
- Interfere with or disrupt the App's infrastructure or other users' use of the App
- Attempt to gain unauthorized access to the App, other accounts, or our systems
- Upload or transmit viruses, malware, or other harmful content
- Use the App to harass, abuse, or harm another person
5. Subscriptions & Payments
Banany offers a free tier and a premium subscription ("Banany Premium"). Premium subscriptions are billed through the Apple App Store in accordance with Apple's terms. You can manage or cancel your subscription at any time through your App Store account settings.
We reserve the right to change subscription pricing. Any price changes will take effect at the start of your next billing cycle after notice has been provided.
6. Intellectual Property
The App and its original content, features, and functionality are owned by Banany and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
7. User Content
You retain ownership of any content you submit through the App (such as profile photos and family information). By submitting content, you grant us a limited license to use, store, and display that content solely for the purpose of providing the App's services.
8. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.
9. Limitation of Liability
To the fullest extent permitted by law, Banany shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the App. Our total aggregate liability shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless Banany and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the App or your violation of these Terms.
11. Termination
We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
